8AM Golf Privacy Policy

This is the Privacy Policy (“Policy”) of 8AM Golf Holdings LLC, a Delaware limited liability company (“8AM,” “we,” “us,” or “our”), located at 6 East 43rd Street, New York, New York 10017.  This Policy describes how we collect, use, disclose, and process your Personal Data (as defined below) when you use any of our websites on which this Policy is posted (each, our “Site”).  Please read this Policy carefully. Any capitalized terms not defined in this Policy are defined in the Terms of Use for our Site. 

Collection and Use of Personal Data

In order to provide our Site, we may collect and process a limited amount of information that relates to identified or identifiable individuals (“Personal Data”). 

Categories of Personal Data

We collect and process the following categories of Personal Data (note, specific Personal Data elements are examples and may change):

• Identity Data: information such as your name; address; email address; telephone number; or other account-related information, such as your interests.

• Contact Data: information that relates to information about how we can communicate with you, such as email, phone numbers, and information you provide to us when you contact or communicate with us via email or through a “contact us” or similar form on our Site.

• Device/Network Data:  information relating to your device, browser, or application e.g. IP address, MAC address, application ID/AdID/IDFA, identifiers from cookies, session history and similar browsing metadata, and other data generated through applications and browsers, including via cookies and similar technologies. We collect this Personal Data automatically from your devices by using cookies and similar technologies when you access our Site.

• Financial Data: information relating to a method of payment, such as your credit or debit card information.

• Preference Data: Personal Data generated reflecting your preferences, characteristics, predispositions, behavior, demographics, household characteristics, market segments, likes, favorites and other data or analytics

• Transaction Data: information relating to transactions you may enter on our Site, such as when you purchase a product or a subscription.

• User Content: unstructured/free-form data that may include any category of Personal Data, e.g. data that you give us in free text fields such as comment boxes, or other Personal Data you may provide through our Site.

Sources of Personal Data

We collect Personal Data from various sources, which vary depending on the context in which we process that Personal Data:

• Data you provide us: We will receive your Personal Data when you provide them to us, such as when you sign up for our emails, create an account on our Site, or purchase a subscription. 

• Data we collect automatically: We collect Device/Network Data about or generated by any device you have used to access our Site.

• Aggregators and advertisers:   We may receive Personal Data from ad networks, data brokers, advertising vendors, market research, and social media companies or similar companies who provide us with additional Personal Data, e.g. Preference Data.

• Social media companies:   We receive Personal Data from social media companies when you use social media sign on, or interact with that social media company on or in connection with our Site.

• Data we create or infer:   We, certain partners, social media companies, and third parties operating on our behalf, create and infer Personal Data such as Preference Data based on our observations or analysis of other Personal Data processed under this Policy, and we may correlate this data with other data we process about you. 

Purposes of Personal Data Processing 

When you use our Site, we process your Personal Data in specific contexts and for certain specified purposes, as well as for our general business purposes.

When you create an account or purchase a subscription on our Site

We collect and process Contact Data and Identity Data when you create an account on our Site. In addition, if you purchase a subscription or product, we will collect Financial Data and Transaction Data. We use Identity Data and Contact Data as necessary to create, maintain, and provide your account and any content or services you may request or to which you may subscribe through your account.  We may also use Identity Data as part of our efforts to improve our Site and to create a personalized user experience. We may collect Device/Network Data when you use your account on our Site, including details such as the content you have viewed or areas of our Site you have visited.  We may also collect, create or infer Preference Data based on your use of our Site and the purchases you make. 

When you contact us

We collect and process Identity Data, Contact Data, and User Content as necessary to address your request, fulfill the business purpose for which that information was provided, or for other related purposes.  This information is primarily used to respond to your request, and to otherwise fulfill our contract or communicate with you, as appropriate.

Marketing Communications

We process Device/Network Data, Contact Data, Identity Data, and Preference Data in connection with marketing communications we may send to you, and when you open or interact with those communications. You may receive marketing communications if you consent and, in some jurisdictions, as a result of signing up for our emails, account registration, making a purchase, or otherwise contacting us through our Site. We process this Personal Data to contact you about relevant products or services and for our general business purposes such as improving our site and providing our products and services to you. Marketing communications may also be personalized as permitted by applicable law.

Contests and Promotions  

We may collect and process Identity Data, Preference Data, certain Contact Data, and User Content when you enter a contest/sweepstakes or take part in a promotion. We process this Personal Data as necessary to provide the contest/promotion, notify you if you have won, or to process delivery of a prize.

Contact Us, Support 

We collect and process Identity Data, Contact Data, and User Content when you contact us, e.g., through a contact us form, or for support. We process this Personal Data to respond to your request, and communicate with you, as appropriate, and for our service improvement. If you consent or if permitted by law, we may use Identity Data and Contact Data to send you marketing communications and for our marketing purposes. We may also share Personal Data collected in connection with a support request with our service providers. 

Service Delivery 

We process any Personal Data as is necessary to provide our Service, to provide you with the products and services you purchase or request, to authenticate users and their rights to access the Service, or various data, features, or functionality, and as otherwise necessary to fulfill our contractual obligations to you, and provide you with the information, features, and services you request. Additionally, we use information to authenticate your right to access our properties and locations, deliver products and services, and for other related matters. Similarly, we may use Personal Data as necessary to audit compliance, and log or measure aspects of service delivery (e.g. to document ad impressions). 

Internal Processing and Service Improvement 

We may use Personal Data in connection with improving the design of our Site, understanding how are Services are used or function, for customer service purposes, in connection with logs and metadata relating to service use, and for debugging and similar purposes relating to our identification of errors and improving the stability of the Service. Additionally, we may use Personal Data to understand what parts of our Service are most relevant to Users, how Users interact with various aspects of our Service, how our Service performs or fails to perform, etc., or we may analyze use of the Service to determine if there are specific activities that might indicate an information security risk to the Service or our Users. 

Security and Incident Detection 

We may process Personal Data we collect in connection with our legitimate business interest in ensuring that our Site is secure, identify and prevent crime, to detect security incidents, protect against, and respond to malicious, deceptive, fraudulent, or illegal activity. We may analyze network traffic, device patterns and characteristics, maintain and analyze logs and process similar Personal Data in connection with our information security activities. 

Feedback and Surveys 

We process Identity Data, Contact Data, Inference Data, Preference Data, and User Content collected in connection with feedback you provide to us, surveys or questionnaires. We process this Personal Data as necessary to respond to your requests/concerns, and other legitimate interests, such as analyzing customer satisfaction.  We may process this Personal Data for marketing or other commercial purposes. We may share data collected from feedback and surveys relating to third party partners with those partners, who may use it for their own purposes.

Cookies and other tracking technologies

We, and certain third parties, automatically collect and process Device/Network Data when you interact with cookies and similar technologies on our Site. Subject to your rights & choices, we may use this information as follows: 

1. for “essential” or “functional” purposes, such as to enable certain features of the Site; and

2. for “analytics” purposes, consistent with our business interest in how the Site is used or performs, how users engage with and navigate through our Site, what sites users visit before visiting our Site, and other similar information, and understand characteristics of users in various technical and geographic contexts.

3. for “retargeting” or similar advertising or commercial purposes, such as: for social media integration e.g. via third-party social media cookies, or when you share information using a social media sharing button or “like” button on our Site or if you link your account or engage with our content on or through a social networking website such as Facebook or Twitter;  

   1. to collect information about your preferences and demographics to help target advertisements which are more likely to be of interest to you using behavioral advertising; and 

   2. to allow us to carry out retargeting (this includes, for example, when advertisements are presented to you for products or services which you have previously looked at on a website but have not purchased).

Note: Some of these technologies may potentially be used to identify you across platforms, devices, and other sites.  Our Site currently does not respond to browser-based do not track requests. 

If you do not want information collected through the use of cookies, you can manage/deny cookies (and certain technologies) using your browser’s settings menu. You must opt out of third party services directly via the third party. For example, to opt-out of Google’s analytic and marketing services, visit Google Analytics Terms of Use, the Google Privacy Policy, or Google Analytics Opt-out.

Compliance and Public Interest

Note that we may, without your consent or further notice to you, and to the extent required or permitted by law, process any Personal Data subject to this Policy for purposes determined to be in the public interest or otherwise required by law. For example, we may process information as necessary to fulfil our legal obligations, or otherwise in the public interest or as required by a public authority. Other Processing of Personal Data

If we process Personal Data in connection with our Site in a way not described in this Policy, this Policy will still apply generally unless otherwise stated when you provide it. 

Data Sharing

Information we collect may be shared with a variety of parties, depending upon the purpose for and context in which that information was provided. We generally transfer data to third parties as described below.

Service Providers

We may share Personal Data with service providers, who provide certain aspects of Site or process data on our behalf. For example, we may disclose information to cloud-hosting providers.

Corporate Events

Your Personal Data may be shared in the event that we go through a business transition, such as a merger, acquisition, liquidation, or sale of all or a portion of our assets. For example, Personal Data may be part of the assets transferred, or may be disclosed (subject to confidentiality restrictions) during the due diligence process for a potential transaction.

In order to streamline certain business operations and for other permitted purposes, we may share your Personal Data with any of our current or future affiliated entities, subsidiaries, and parent companies. 

Third Party Content Providers

Our Site may contain links to content hosted by third party sites and we are not responsible for, and have no knowledge regarding, the data they may collect from you when you visit their site, or how they use it.  Please review those third-parties' privacy policies before disclosing information to them. 

Legal Disclosures

In limited circumstances, we may, without notice or your consent, access and disclose your Personal Data, any communications sent or received by you, and any other information that we may have about you to the extent we believe such disclosure is legally required, to prevent or respond to a crime, to investigate violations of our Terms of Use or a customer agreement, or in the vital interests of us or any person. We may, in our sole discretion (but without any obligation), object to the disclosure of your Personal Data to such parties.

USE BY CHILDREN

Our Services are neither directed at nor intended for use by children under the age of 13. Further, we do not knowingly collect Personal Data from such individuals. If we learn that we have inadvertently done so, we will promptly delete it. Do not access or use the Services if you are not at least 13 years old.

Security

We implement and maintain reasonable security measures to safeguard the Personal Data you provide us. However, we sometimes share Personal Data with third parties as noted above, and though we may enter contracts to help ensure security, we do control third parties’ security processes. We do not warrant perfect security and we do not provide any guarantee that your Personal Data or any other information you provide us will remain secure. 

International Transfers of your Personal Information

If you use our Sites outside of the United States, you understand and acknowledge the transfer of information about you, and the collection, processing, and storage of information about you, in the United States and elsewhere.  The laws in the U.S. and these countries regarding personal information may be different than the laws of your state or country.

Your Rights & Choices

List of Direct Marketers

California residents may request a list of Personal Information we have disclosed about you to third parties for direct marketing purposes during the preceding calendar year.

Remove Minors’ User Content

Residents of California under the age of 18 can delete or remove posts using the same deletion or removal procedures described above, or otherwise made available through the Site. If you have questions about how to remove your posts or if you would like additional assistance with deletion, contact us using the information below. We will work to delete your information, but we cannot guarantee comprehensive removal of that content or information posted through the Site.

Updating Your Personal Information 

If you have an account with us, you can update your information or adjust your contact preferences by logging in to your online account.  

Nevada Privacy Rights – Opt-Out of Sale

The Nevada Revised Statutes (NRS 603A.300 et seq.) permit a Nevada consumer to direct an operator of an Internet website or online service to refrain from making any sale of any covered information the operator has collected or will collect about that consumer. You may also have similar rights under other state laws. 

Withdrawing Your Consent/Opt-Out

You may withdraw any consent you have provided at any time. The consequence of you withdrawing consent might be that we cannot perform certain services for you, such as location-based services, personalizing or making relevant certain types of advertising, or other services conditioned on your consent or choice not to opt-out.

Marketing Communications

You can withdraw your consent to receive marketing communications by clicking on the unsubscribe link in an email (for email), by responding with “OPT-OUT,” STOP, or other supported unsubscribe message (for SMS), or for other communications, by contacting us using the information below. To opt-out of the collection of information relating to email opens, configure your email so that it does not load images in our emails.
